Terms & Conditions

Photographer's Responsibilities ("Services").

(Photographer") Photographer hereby agrees to perform photographic services for Client at the session specified above in a professional, workmanlike manner according to the prevailing standards in the industry.

Retainer/Payment. A non-refundable retainer (that shall be applied toward the total fee for the Services) of 40% of the session package is due upon execution of this Agreement, at which time Photographer commits to being available to Client on that date (subject to non-payment, reasonable emergencies and unforeseen events). Final payment of the balance due the day of the session.
In the event that Client fails to remit payment as specified, Photographer shall have the right to immediately terminate this Agreement with no further obligation to refund money (including the aforementioned retainer)

Term. The term of this Agreement shall commence upon the execution of this Agreement, and shall terminate upon
Photographer's delivery of the final edited digital images, either via email link, to the Client, unless terminated earlier as provided herein.

Session Changes. Photographer must be notified immediately of any changes in schedule or location, at least 48 hours in advance of the scheduled session date. If you have to reschedule, you will not lose your retainer fee. Just make sure your session is rescheduled within 30 days of the original session date.
Outfits: Although outfits changes are included, the amount of time it takes to change into those outfits does count towards the total amount of the session time.

Location Access and Fees: If the Client wants to do a session at a location or another studio that charges for access, the Client will be responsible to cover fees associated with shooting there, and all parking fees.

Entire Agreement. This agreement contains the entire understanding between Photographer and the Client. It supersedes all prior and simultaneous agreements between the parties.
The only way to add or change this agreement is to do so in writing, signed by all the parties. If the parties want to waive one provision of this agreement that does not mean that any other provision is also waived. The party against whom a waiver is sought to be effective must have the waiver in writing.

Model Release. Client agrees that Photographer may use images of Client from any portion of the Work for display, publication, or other promotional uses without payment of additional compensation to Client or Client's agents.

Cancellation.
Upon acceptance of these terms and payment of the retainer, Photographer shall commit to attending the session at the specified date and time, and shall make no other reservations for that date/ time. If Client cancels the session entirely, then Photographer shall be entitled to 100% of the retainer as liquidated damages. In the unlikely event that the Photographer is injured or becomes too ill to photograph the session, Photographer will make every effort to reschedule the session. If the situation should occur and a reshoot does not work out, responsibility and liability is limited to the return of all payments received for the session package.

Delivery Date. You will receive a link to view your proofs via an online gallery within 24-72 hours of your session and you'll have one week to select the photos that you would like. Once photographer is notified (via email/text) that the selection process is completed, the editing process will begin. Look to receive your final gallery within 10 business days of the start of that process! In the event of a request for additional edited images, the client must settle the invoice before the processing of their gallery commences. The digital images shall be delivered via an online gallery. Photographer does not guarantee to store or host Client's digital images. If digital images have been delivered via email link, Client has 30 days from the date of delivery to download the digital images.

Tardiness: In the event that the Client is late to the appointment set, the client's session will still be for the same scheduled ending time.
